The Website is operated by SpaceTime Co., Ltd., a company registered in South Korea (“SpaceTime”, “we”, “us”, or “our”). Gallery SpaceTime is a division of SpaceTime Co., Ltd..

If you use the Website as an employee or representative of another legal entity, by using the Website, you indicate that you accept these Terms on behalf of yourself and such legal entity. If you do not agree to these Terms, please refrain from using the Website.

IMPORTANT NOTICE: NO E-COMMERCE TRANSACTIONS

Gallery SpaceTime operates exclusively through private sales and advisory services. This website does not facilitate direct e-commerce transactions, shopping cart functionality, or online payments. All artwork acquisitions are conducted through private negotiation and consultation.

When artwork is described on the ‘Collection’ page of the website as “Available”, it means that the artwork is currently for sale from the Gallery SpaceTime. However, please be aware that there may be a waiting list of interested buyers and the artwork will continue to be shown as ‘Available’ during negotiations until a sale has been concluded. We therefore recommend enquiries from visitors interested in acquiring any artwork shown as available but do not guarantee the artwork will be available for sale.

CERTIFICATE OF AUTHENTICITY (COA) DISCLAIMER

While Gallery SpaceTime strives to provide accurate information about artworks, certificates of authenticity are issued based on available information and research at the time of sale. We make no absolute guarantees regarding attribution, provenance, or authenticity beyond what is explicitly stated in the certificate of authenticity provided with each artwork.

2. Intellectual Property

All the content of the Website, including all text, images, videos, sound recordings, documentation and software, as well as the design, graphics, and layout of the Website (the “Content”) is the proprietary property of SpaceTime Co., Ltd., and is protected by copyright laws, trademark, and other intellectual property laws.

The names, titles, trademarks, service marks and logos that appear on the Website, including without limitation SpaceTime, are registered marks of SpaceTime Co., Ltd.. Except as expressly set out in these Terms, you shall have no rights in respect of any such intellectual property rights.

The Content on the Website may not be used, copied, reproduced, distributed, modified, displayed, performed, created as derivative works of or used for any commercial purpose, in whole or in part, without first obtaining the written authorization of SpaceTime Co., Ltd. and permitted under these Terms of Use.

You may access and view the content on the Website on your computer or another device. Unless otherwise specifically indicated in these Terms, use of the Website and the services offered on or through the Website are only for your personal, non-commercial use. The following are not permitted:

  • Reproduction of website content for commercial purposes or unauthorized use of content and ideas obtained or derived from the website;

  • Using any images, text, artwork descriptions, or other content from this website for training artificial intelligence (AI) or machine learning (ML) models without prior written consent from SpaceTime Co., Ltd.;

  • Automated scraping, crawling, or harvesting of artwork images or content using bots, scripts, or other automated tools;

  • Impersonating an individual or organization, including SpaceTime Co., Ltd. and its employees, agents or representatives;

  • Upload, post, transmit, or otherwise make available any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, obscene, indecent, or offensive materials that infringe on the privacy of artists belonging to Gallery SpaceTime;

  • Interfere with the operation of this Site or violate any security features;

  • Attempting to circumvent, disable, or interfere with security features, watermarks, or copy protection mechanisms on the website.

B. LINKING TO THE WEBSITE

You may connect via link from any website you own, as long as you do not violate the terms and conditions presented by this website in a fair and legitimate manner and do not damage the reputation of Gallery SpaceTime or SpaceTime Co., Ltd.. However, the link shall not be established in such a way that SpaceTime Co., Ltd. offers certain alliances, approvals, or warranties that do not exist or are not presented. Framing the content of a website (i.e., displaying the content of this website on any other website without permission) is strictly prohibited.

NEITHER SpaceTime Co., Ltd., ITS AFFILIATES, TRUSTEES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS SHALL HAVE ANY LIABILITY FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, ANY DIRECT, INDIRECT, INCIDENTAL, COMPENSATORY, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) ARISING FROM OR RELATED TO YOUR USE OF THE SITE, CONTENT, AND/OR COMPILATION.

8. Copyright Infringement Claims & DMCA Procedures

DMCA Takedown Procedure

  3. A description of where the material that you claim is infringing is located on our website (including URL)

Response Timeline

  • Acknowledge receipt within 2 business days
  • Investigate the claim within 5 business days
  • Remove or disable access to infringing material promptly upon verification
  • Notify the alleged infringer of the takedown

Counter-Notification

If you believe your content was wrongly removed, you may submit a counter-notification containing:

  1. Your physical or electronic signature
  2. Identification of the removed material and its former location
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
  4. Your name, address, telephone number, and consent to jurisdiction

9. Forensic Watermarking & Digital Rights Protection

Invisible Watermarks

All images on this website contain invisible forensic watermarks that embed identifying information including:

  • Gallery ownership identification
  • Artist attribution
  • Timestamp of original upload
  • Unique tracking identifiers

These watermarks are designed to survive common image manipulations including cropping, resizing, compression, and format conversion.

Purpose of Forensic Watermarking

Forensic watermarks allow us to:

  • Prove ownership of images found on unauthorized websites
  • Track the source of leaked or stolen content
  • Support legal action with verifiable evidence
  • Identify infringers through embedded tracking data

Removal, alteration, or circumvention of forensic watermarks constitutes a violation of:

  • Section 1202 of the DMCA (Integrity of Copyright Management Information)
  • Korean Copyright Act Article 124 (Prohibition of circumvention of technological measures)

Violators may be subject to both civil and criminal penalties under applicable laws.

Forensic watermark data extracted from unauthorized copies will be used as evidence in DMCA takedown requests, cease and desist letters, and legal proceedings in both Korean and international jurisdictions.
